Question 1

What do you need to self-manage your VvE?

Accepted Answer

A few things need to be in place:
A board, appointed by the owners’ meeting (Article 5:131(2) of the Dutch Civil Code). A property manager is not required.
An up-to-date KVK registration listing the current board.
A bank account in the name of the VvE, and the reserve fund in a separate account in the name of the VvE (Article 5:126(3)).
Your deed of division and regulations at hand: they contain, among other things, the rules on meeting notices and majorities.
Buur is being built to help you with this step by step once the app opens.

Question 2

Which documents do you take over from the property manager?

Accepted Answer

Ask the property manager to hand over the complete administration. For example:
The deed of division, the regulations of division and any house rules
Minutes and decisions of previous meetings
Annual accounts, budgets and bank details, with an overview of outstanding items
The multi-year maintenance plan (MJOP)
The list of owners with fraction shares and contact details
Current contracts, such as the buildings insurance and maintenance contracts
The owners’ meeting decides on assigning tasks to a property manager. Check the agreement for the notice period.

Question 3

Do you need to update anything at the KVK?

Accepted Answer

Yes, if the board changes. The VvE is registered in the Business Register and every board member is obliged to file the registration. A change, such as a new board, must be reported no later than one week after it takes place (Commercial Register Act, Articles 18 and 20).
To register a new board, the KVK asks for the signed minutes and the attendance list of the meeting in which the board was appointed. If the property manager was registered as an authorised representative, have that registration updated too. More in the knowledge base: VvE KVK registration.

Question 4

What happens to the reserve fund?

Accepted Answer

The reserve fund belongs to the VvE and stays that way. The money must be in a separate current or savings account in the name of the VvE (Article 5:126(3) of the Dutch Civil Code). If it is currently in an account that is not in the VvE’s name, arrange for it to move to an account of the VvE itself.
After the switch, the VvE still sets aside at least the amount from the MJOP or 0.5% of the rebuilding value every year (Article 5:126(2)). More in the knowledge base: Reserve fund.
