Deed of division (splitsingsakte)

The deed of division is the notarial deed that divides a building into apartment rights. It includes a drawing and a set of regulations.

The deed of division is the founding document of every VvE. The division is made by a notarial deed that is registered in the public registers (article 5:109(1) BW). A drawing showing the boundaries of the private parts is attached to the deed (paragraph 2).

Among other things, the deed must state where the building is, describe the private parts, give the cadastral designation of the apartment rights and contain regulations (article 5:111 BW). The deed often refers to a set of model regulations for this, sometimes with additions.

It can be amended with the cooperation of all owners, or by the board on the basis of a decision with at least four fifths of all votes (or a larger majority if the deed requires it). The notice period for that meeting is at least fifteen days (article 5:139 BW). You can order a copy of your deed of division from the Kadaster (Land Registry).
