Proxy (volmacht)

With a proxy, an owner lets someone else attend the meeting and vote on their behalf. Under the Model Regulations 2017 this can be done in writing or by email.

If you cannot attend the meeting, you can authorise someone else with a proxy. Under the Model Regulations 2017, every owner may attend, speak and vote in person or through a proxy appointed in writing or by email, who does not have to be a member of the VvE (article 53.1).

One important restriction applies: a board member cannot act as proxy for a person entitled to vote. A proxy signs the attendance list on behalf of the owner (article 50.3) and counts towards the quorum, because what matters is votes present or represented.

In a proxy, clearly state the proxy's name, the apartment, the date of the meeting and any voting instructions. Check your own regulations for any extra requirements.
