Statement on sale (5:122 statement)

When an apartment is sold, the notary attaches a statement from the VvE board to the deed, showing outstanding contributions, the reserve fund and the VvE's debts.

When an apartment right is transferred, the notary ensures that a statement from the VvE board is attached to the deed (article 5:122(5) BW). It sets out what the seller owes the VvE on the day of transfer and what they are liable for. The statement also shows the size of the reserve fund and the VvE's debts (paragraph 6).

The statement protects the buyer: towards the VvE, they are liable no further than the amount shown. A correct statement therefore matters to the VvE; a forgotten arrear can no longer be recovered from the buyer.

After the transfer, the new owner must notify the VvE in writing without delay (article 5:122(2) BW). In a dormant VvE without an active board, preparing this statement can cause delays.
